State Specific Question About: VIRGINIA (VA)
I had a verbal agreement with a girl to live in my home for 2 months for no rent as long as she did some things around the house-she was in jail for 3 months for shoplifting and lost her apartment-(did not know at the time it was her 5th felony)She ende up living free in my home for an additional 4 months. I had a job in Canada - and needed someone to watch my home. She ended up shoplifting again while on probation. I came back home last month and realized she had stole my personnal belongings-sold stolen merchandise on E-bay plus had garage sales where she sold my things. She then assulted me-started destroying my things(I have pics)and the police came and arrested her. She had two court hearings in May for her shoplifting charges-and is in jail for 2 yrs. I have some of her belongings and my neighbor is threatening me (as she has stated that she is her power of attorney and will file a warrant in debt against me if I do not let her get her things. I have tried several attempts - but again today my neighbor will not pick up her things!! What can I do with her things!!! Let me ask this! When I allowed her to move in for a few months-we had a verbal agreement that she would fix some things around the house-she did. But, stupid me, living in Canada, verbally told her to pay me after those two months but she never did. Because we had that agreement, does that make her a tenant? Can anyone give me the exact law that I need to put her stuff out? When I had called the cops as I found stolen merchandise in my home that she was selling on e-bay-they said I had to give her 30 day notice, so that makes her a tenant, or were the cops wrong? I had done that but stupid me, did not save the e-mail. So, I do not want to get in trouble for her stuff??? I need any law that will support me! I also, changed the locks! HELP!!!! --68.10.xxx.xx |

It seems that your best plan would be to find an attorney to help you. If you're low income, your local bar association may have lawyers who work on a reduced fee basis. This is serious stuff, and may cross over into landlord/tenant law - so ask for someone with that kind of knowledge.

What a sitch! What if most of her things are stolen? This neighbor has no documentation that she has power of A. Or she would have thrown it in your face.
I don't think you can turn it over to the police as possible stolen items. Put it on the curb and call the neighbor. Shrug....
File a police report of the items she stole from you and sold. So it's on record.
Why is this neighbor so tight with this person? Your neighbor may have purchased more of your things and is thinking they are
hers now that the shoplifter is in jail.
I would get a security system installed yesterday. Even if everything of value is gone. Just so I could sleep at night.
You better check on ID theft. Leans on your house etc.

I have done all the above! The girl is in jail for two years for her shoplifting charge. I recovered some money from my insurance co and filed a police report. I have assult and destruction of property charges against her this next mo. She pushed me plus started destroying my personnal property when I found out what she was doing in my home - it was like she was having a temper tantrum. I am not worried about my charges against her - I am concerned about what to do with her things in my garage??? She has threatned to file a warrant in debt against me plus she has filed a police report stating I stole some jewelry (which is a lie) I do not know what to do with her things as I had her arrested for the assult charges and she never had time to do anything with them. Most of her things are in storage but a few items are in my garage??? --68.10.xxx.xx |
