State Specific Question About: MARYLAND (MD)
Does anyone know about burglary in the 4th degree in Maryland?
I actually walked in on my ex-tenants who broke into the garage taking their belongings. The court ordered them to get their belongings and they didn't. I gave them yet another chance to get their belongings and they still didn't.
I come home to find that they had broken the glass to the garage door and we literally passed each other during their theft. The police chase them and let the go saying the stuff they removed was theirs. One of them cut their hand and bled all over the garage door and driveway.
I spoke to State Attorney who said it all comes down to a broken glass worth about $25 and it's not worth going to a trial.
This is absolutely ridiculous, I feel. These ex-teanants are BURGLARS!!!!!!!!!!!!!!!! --64.12.xxx.xxx |

Police don't want to get involve any more with these type of crimes.
They need to be very cautious about profiling, trial lawyers just love the deep pockets of cities. --76.122.xxx.xx |

Gee, When the court originally allowed the tenants to get their belongings and even when you gave them a second chance, were the items still at the rental at that time? At what point were they brought to your home and why your home?
I would also encourage you in the future not to ever volunteer any information to residents of where you personally live. --68.244.xx.xx |

You should at least tarp the stuff out of view. --76.241.xxx.x |

one of the worst things I see in this business is all of the small crimes that happen that I can't do much about, and it's often best to just focus on the future and get back to work. It is disheartening that these people continue to operate this way, but bottom line is you can't fix or punish them all.

The crime is not burglary, but breaking and entering a home. In Indiana that is a felony, even if they did not take anything.
File a Police report, and then call someone in charge of the Prosecutor Office, and then go up there, if all else fails call the newspaper, for all you know they had a gun.

In CA they would be breaking and entering.
In the document I send them notifying them to pick up their things I tell them if they attempt to break in and retrieve their things at any other time then the agreed time frame that they are breaking and entering and I will call the police.

The tenants were about to be evicted, but they moved out before the eviction proceeded. They left the things inside the home, but I had changed the locks. They attempted to get the stuff became routy and one was arrested for misconduct. I filed a peace order and the court eventually ordered them to get their stuff. They didn't comply. So then they broke in and got what they still wanted. --64.12.xxx.xx |
