State Specific Question About: INDIANA (IN)

Can a landlord issue a 5 day eviction order for non payment and it be legal or must one go thru the court eviction process which takes a period of weeks and is expensive. --68.249.xxx.xx

The notice is served as the official cure/quit, then if nothing is paid you file eviction and wait about 10 days for the court date, if this is your first you may want to find a flat-fee eviction service, in my area they cost 350-400 for both actions meaning unlawful detainer then second cause for money award after unit is emptied out for deposit evaluation - take photos and compare to move-in photos, you need 3 copies of the lease in most courts - and notices must be made with correct type size/style - speed read your local and state laws to stay in control of your property. Once you know the lamdlord laws the judge will be able to help you more, and you will have more time to enjoy this business. --76.241.xxx.x

You can tell them to leave and if they don't they go to the courthouse and fill out the papers for an eviction.

I've only had to do that a few times after I explain how much trouble the tenant will be in for a long time if they end up in court. They will have bad credit report and have difficulty finding another apt. --76.99.xxx.xx

Evictions are costly and time consuming where the tenant rides out free rent until the sheriff is at the door. One has to go through the legal process even though the tenant continue to live rent free and get services until the sheriff arrives. There is no fast track inexpensive eviction. Here it costs $170.00 for the hearing and $425.00 for the sheriff. It often takes 6 to 7 weeks. In many cases it amounts to months rent plus the arrears. Thorough credit checks on adult applicants cut down on the number of evictions. --216.110.xxx.xxx

Wow. That's expensive.

One thing that I've learned also is to have tenants with some sort of means to get your money back after you evict: wages, bank account, car, etc. At least you can recoup the expenses of getting them out. --76.20.xx.xxx

I am looking to evict a woman who is 3 months behind on her rent and works for the Sheriff's department. I have tried hard to work with her and gotten her to agree to add partial payments to the resnt to get caught up but she has not done it. Now I want to just evict her. I anticipate her not getting caught up on her rent and losing funds. In fact I could not pay the house note without getting the rent so the house may be lost.

I want at the very least to be able to put her horrible pay record on her credit report and I am willing to be able to do this. How can I do this? --76.253.xxx.xx
