Can a landlord issue a 5 day eviction order for non payment and it be legal or must one go thru the court eviction process which takes a period of weeks and is expensive. --68.249.xxx.xx |

Thomas, you see you have not had any responses since yesterday--that is because the question is pretty obvious. Just in case you really don't KNOW--a LL cannot technecaly EVICT anyone--only the COURTS have the authority to evict! The LL applies for an eviction and then the LL and the tenant go to court, and the judge makes that determinatoin and you get a court ruling.
If you have a bad tenant that you want to get rid of, you can send a Notice to Cure the bad behavior, and threaten en eviction--but if they don't comply--you have to be ready to go thru the eviction. You can bribe them to leave(LLs hate to do this as it is rewarding bad behavior) but it ends up being less expensive that a court procedure. If on a M2M agreement you can send a notice to vacate with no explanation--or you can just raise the rent $200/mo!
If you gave him a regular 1 yr lease, you will have to abide by the lease and go thru the court system if you can't get him out any other way. --137.242.x.xx |

An uncontested eviction is not lengthy nor expensive. Look up the process for your state online. It's not that bad, but you MUST be thorough with your paperwork.
Uncontested will get them out in about 2 weeks for less than $300 in fees.
Contested will cost more, but it's the legal way to get them out. --76.20.xx.xxx |
