State Specific Question About: GEORGIA (GA) My tenant broke the lease 5 days after moving in and vacated the property. I used standard GAR Form which has a no early termination clause. Is the tenant responsible for the remanding rent due? I have found another tenant to move in one month.

Here, tenent owes until you re-rent. You have to prove you are making the effort. He is also on the hook for expenses, advertising, damages. Good luck collecting though. Sounds like you are making out OK if he is out and you can move on. --65.189.xxx.xxx

I assume that since they were in, they paid for their first month, correct? And you already have another lined up for the next month? If so, then you likely can't collect anything extra from them (or keep their S/D even). Sucks, I know -- but that's the way it is. If you had to do extra advertising to get that person in there -- and you can document it -- then you can deduct that and keep it, at least -- but that's about it since you found a new tenant so quickly.

In the future, I'd use an early termination clause that gives you something as a fee for the termination. Granted, doesn't work everywhere -- but at least gives you a reason to try it -- and, usually, it isn't worth them to fight it.

As Jeffrey pointed out earlier in the holiday weekend, the main focus is getting the rent money to flow again, then sort out the pro-rated recovery cost - once you do this calculation a few times you will know the answer almost as fast as the old tenant asks the question. --76.241.xxx.x
