State Specific Question About: NORTH CAROLINA (NC)
Any here gotten notice for remediation of lead? I received one from the county for a very small reading of lead in one of my rentals. Anyone have experience with this process? --75.183.xx.xx |

Who took the reading? What surface was it on? A door? A window?
No one does that in NJ at this time at the state or local level. A tenant whose child shows a level of lead in his or her blood might go to the health department about it. Is this what happened?
What were the numbers on the reading?

Doctor's can prove how long the lead has been in a persons body. If there is lead in one of your tenants or tenants child's body, they can find out how long it was there.
If it is from your unit itself, who has the right to test it without your knowledge? --209.74.xx.xxx |

I don't believe that is true unless the Dr has past lead tests to compare.

What NC county and what specific agency did the testing? Same agency demand remediation? How did they gain access to the interior of the premises? --66.226.xx.xxx |

That came from the instructor of the course. He said if there is ever an incident where you are being blamed for lead poisoning, a doctor can test the persons blood and be able to tell how long it has been in the persons system. --209.74.xx.xxx |

So that health information came from some lead instructor? I'd take it with a grain of salt or three. I'm with Carol on this: I did some quick searching and it looks like they cannot determine how LONG someone has been exposed.
That's the problem that we LLs are concerned about. Someone comes into a rental and the kid is later diagnosed has having lead -- and they don't know WHEN it happened.
It'd be great if I were wrong on this though. So, if anyone finds anything to back up the claim that a doctor can tell from a blood test how LONG ago someone was exposed to lead, that would be good information to have. Please point us in the right direction of something that indicates that -- because I couldn't find it...

Ok -- I did some more research and it looks like some tests can be done to indicate of the lead exposure was very recent -- but that's about it. In other words, for acute exposure -- where someone suddenly has symptoms of lead poisoning -- they can do blood and x-ray tests to determine if they ate lead paint chips within the last week or so, for example.
But it can't be used to determine gradual exposure (i.e. ongoing lead dust or people growing up near smelters, for example) times or even acute exposure from months or years ago.
So, when a LL usually gets into this situation, it is because a kid was exposed "sometime" over a longer period of time (or they ate paint off of some toy a year before they moved into your place) -- so determining WHEN that exposure was appears to be difficult to impossible.

Act on it quickly by asking the test outfit what they recommend and counter the offer by asking "can I just replace the faulty wood window sill and be done?" and ask for a letter stating all is well for your records. --76.241.xxx.x |
