First off, I would not be in your situation due to not turning over keys until all money has been paid and lease signed. But, here is how I would handle it if I was in your situation:

1. Send a 5 day notice to pay or quit immediatly.

2. After 5 days (weekends count in VA) go to your local court house and file an unlawful detainer. Cost about $68 for two people.

3. Write out a timeline of all events and wait for your court date. They most likely won't show and you will win by default judgement.

4. Immediatly after court, go back to the clerks and file a writ of possession. Cost about $37.00.

5. Wait for the sheriff to show. Will take about a week depending on your local sheriffs office. You will have a choice of doing a lock out or moving all items to the curb. I do lock outs, but keep in mind if you do a simple lockout, you must make yourself available during reasonable hours for the next 24hours so that they may come back and remove anything else they have left behind. Usually they are gone by time the sheriff shows and all their treasures become yours. Last week I had my first one actually come back. Thankfully they removed all but 3 truck loads of junk. I was thankfull.

6. Learn better screening techniques.

7. Look in the mirror, chew yourself out over this poor choice of tenants and then forgive yourself and move on. --96.225.xxx.xxx
