State Specific Question About: ALABAMA (AL)
I have a tenant that took advantage of the first-time home buyer's tax cedit. Her lease was due to expire on September 01, 2010. Per my request, she notified me in writing on the 5th of May 2010 that she was infact moving at the end of May. Do I have to return her security deposit? TJ...a rule of thumb for early lease breaks is that the lease breaker must pay 1-2 months rent for the break, plus pay the utilities and rent until a new tenant is signed up...

Did you try to rent the place right away? I had a tenant also do this, and we simply put the place up for rent as soon as I found out they were going to move. I had a tenant lined up for two days after they moved out. I told them ahead of time (too late for you) that they would be liable for any lost rent, but they only had to pay for the two days. They left it very clean and received their entire deposit back (which does not happen very often!).
As far as whether you have to return it, check your state laws. If she gave you notice, per your request as you stated above, I don't think that qualifies as abandonment. --74.215.xxx.xx |

Not sure specifically about AL. But, "..per my request.." is a little troublesome. Generally, one can withhold SD for non-payment of rent. Not giving sufficient notice is sometimes a basis for withholding the SD.
