Again I'm having even more problems with ex tenants who owe me over $7000 for rent and damages. They moved out at the end of the lease. I am waiting for my small claim to come up in court for money owed.
I changed locks and they tried to re-enter to get stuff left behind. They caused a scene and the police were called. One tenant was arrested for disorderly conduct. The case got dropped becasue the police were no-shows!!
We went to court on a peace order and the judge ordered them to get their stuff on two ocassions. They didn't comply. Now they still want their stuff. My lawyer advised me to send them a certified letter and give a specific date and time to get their stuff. I did this and THEY STILL DIDN'T SHOW UP!!
I left the house and came back to catch them in the act of retrieving their stuff and burglarizing my house!! They were shocked!!! They broke my glass, blood is all over the garage door and the drive way. I call 911 and the cops chase them. The COPS LET THEM GO BECAUSE THEY SAY THE STUFF IS THEIRS!!! Do you believe this???? Maryland cops let them go because the stuff is "THEIRS" I'm told I can file a destruction of property suit.
What are your thoughts??? This is driving me crazy. I don't think being a landlord is for me........ Help!!

Get a storage unit that you put on the lawn called a POD. Put their stuff in it and mail them the key.

Unfortunately I did not check these deadbeats out. I checked with a previous "landlord" gave a glowing reference.
Turned out to be a relative.

It can happen. Horrible learning experience for you. I usually don't trust prior landlord recs becuase if you REALLY want a bad tenant out - you sure aren't going to tell them how horrible they are & that they owe you back rent. I always do credit & back grnd cks. I also call employers. Chalk it up to a learning exp and move on. I would go after them in court, write to mayor about police "help or lack there of," & post a guard dog inside in case they come back. (a vicious one!) Good luck --24.117.xx.xx |

SELL... you said being a landlord is NOT for you. I agree with you.
However, if you want to be landlord, get a POD... tell them to call you, and then schedule a Garage sale.
Take pictures of the DAMAGE. SUE in Small Claims court, GET The JUDGEMENT and file on the DEADBEATS.

I would write a letter to the mayor, and if no adequate response, your city council person, and as a last resort I would write a letter to your local newspaper editor. GEE, I would have never left any of their stuff IN MY PROPERTY! After they ignored the court order AND the date for pick-up, I would have taken out every last item and moved it to a storage facility and given THEIR name as the owners and the renters of the storage. Then the bill from the storage facility would have gone to THEM to pay--and MY property would have been empty to repair, clean and get re-rented.
You gave them too much time--and you kept their goods where they could easily break-in and retrieve at their leasure. The fact that it is THEIR goods is what muddied the waters for the police. If you had a copy of the court papers showing the date by when they were to retrieve the stuff--you could have shown it to the police and said--"After this court specified date--the goods no longer belong to these people because they did not comply with the judge's ruling! Now under the laws of abandonment--the goods belong to me! Would you like a copy of this court order?" I keep a copy of all important documents in the glove compartment of my car.
I'm sorry you had to go thru this. But next time you will know to take possession and REMOVE all belongings from your property. --137.242.x.xx |
