State Specific Question About: ARIZONA (AZ)
I am a party- one of 3- on a deed on some property here in Phoenix. The persons on the deed are myself, my daughter Gabriela Garcia and my niece Sonja Garcia. Prior to getting the deed in all of our names, I was told that by allowing my niece on the deed that it would insure myself and my 2 children would not have to vacate the property as everyone was to be in agreement as to the rules- ( paying the mortgage etc).....so I agreed to allow my niece to be put on the deed- now I no longer live there because my niece has misused her power ( being a third party on the deed) and between she and my brother in law and sister in law- ( who also live in the home) they have made drastic changes to the property and have caused the property value to decrease. How can myself and my daughter get my niece off the deed? Please advise. Thanks. --174.17.xxx.xxx |

There are two things you can do, first is to buy them out. The Second is to get a lawyer and have him petition the court for an "equitable Distribution of Funds". This will force the sale of the property at a sheriffs sale and the proceeds will be divided among those on the deed. You need to go back to the person who advised you to place your niece on the deed with you and have them go to court with you. It sounds like all three of you will need to settle this in court. Try to settle it out of court if at all possible, after all, she is still family. Good luck! You should not have allowed your niece to be on the deed with you. But thats water under the bridge at this point; while it may have been an easy process to place your niece on the deed; it will not be easy nor cheap to remove her from the deed if she refuses to go along
Once you place her on the title she became an equal 1/3 owner in the whole; so your options are either buy her portion out right or seek legal recourse; Consult an Real estate lawyer in AZ to get the feel on the cost to litigate this matter. It could easily be a 15K for you to initiate a suit to wit even if you are successful she would still be entitled to fair compensation for her 1/3 interest in the property , with little chance of being awarded attorney fees --69.248.xx.xxx |
