State Specific Question About: OREGON (OR)
I have not run into this before, but want to look into it before it becomes an issue.
Can you reject someone in the state of Oregon who has a medical marijuana card? This is a non-smoking unit, so I would assume that would handle it, but I'm not sure.
Thanks, --70.102.xx.xxx |

Be careful, they can ask for reasonable accomodation. Check with Fair Housing
fhco.org/ or asked local association; as I have heard you can't turn them away. If you do rent to someone watch out for moisture problems caused by growing plants. --71.216.xx.xxx |

Hi Andy.. and very good questiion
Yes... you do not have to accept OMMP card holders... however they do not have to disclose they have one..either
If you ask the question directly you should get a direct answer
State in your written rental criteria, you must have one in Oregon, (DOJ says so)
Simpy say this is a non smoking property.. in or on by anyone at any time
Understand that they can medicate with chewables and not smoke..and you would not know or be affected..
For the smoking patients they cannot smoke outside.. it is in the law..
get on the Or dept of human serv. site

They have a right to smoke this WEED. I see a lawsuit if you don't allow them to. Discrimination I presume. --209.40.xxx.xx |

Good answer OPM, I did not know there were chewables, nice to know. --208.252.xxx.xx |

Jim,
The issue of weed aside, we have spent thousands of dollars to remove the smoke damage from the previous tenent (under previous owner). Since we made the place "no smoking" I would like that to mean all smoke. If someone can get the benefits from "weed" through other means then I am fine with that. I really don't need to get into a philosophical discusion about MM. --70.102.xx.xxx |

Other than the smoking aspect of the MMJ I don't believe I'd be too concerned . It can be eaten as in the brownies or made into a tea .there is even an extract that's in capsule form. If the person has been prescribed Morphine I don't know many people that would get wrapped around the axle over that. It's just another drug no better or no worse. --70.248.xxx.xxx |

You simply stick to 'no smoking' in the unit.
Don't ask if they are disabled and have an identification card for MM. They simply cannot smoke in the unit, whether or not they have a state licensed card. There are other alternatives to smoking the product.
Some people would not care if they smoked MM in an apartment. I would be more concerned for the welfare of the other tenants and the passive ''smoke'' if you know what I mean. --70.189.xx.xxx |
