State Specific Question About: MARYLAND (MD)

Tenant move out at expiration of lease. I change locks. Tenant tries to regain access to property to get belongings left behind.

I filed a Trespass Order, which eventually got dismissed after the judge ruled the case was Landlord Tenant.

Prior to that the first judge ORDERED the tenant to get his stuff, giving him not one, but TWO days to do so. He NEVER showed up!! Now he is sending me emails to which I simply ignore. DOES HE HAVE A RIGHT TO HARASS ME NOW??????????

He owes me $7000 for unpaid rent and damages.

More info needed. Tenant moves out at end of lease. Yet they owe you $7,000 in rent and damages? Why didn't you evict for non payment of rent? What kind of damages?

No he doesn't have the right to harass you.

It does leave us wondering what really happened.

Did you do any self help eviction actions? Is this ex-tenant a friend, relative or ?

How long have they lived in the dwelling?

To describe what happened, here it is:

Maryland is backed up with evictions. So from the time you file, it can take 4ever.

Tenant had a year lease, and destroyed my plumbing twice. The second time was deliberate. He is not a relative. It appears he is mad because he has to pay rent. I took him to court for breach. The judge ordered us to work it out. I thought we did but he reneged, and had refused to pay for rent and damages. My attorney informed me to reinstate the motion, but it was denied. I filed a failure to pay rent charge and won a partial judgment. The tenant and I stopped all communication and he moved out at the expiration of the lease and tried to re-enter after the locks were changed. Then I filed the trepass suit. The judge ordered him to pick his stuff up, giving him two separate dates which he failed to do. Now he wants his stuff.

I don't know MD law, but I did live there as a kid!

In Indiana, you cannot mess with their stuff, no matter how much they owe. Our judge told us he has zero tolerance for LLs toying with tenants' personal property.

Be blameless in court. You'll need the judge's good favor as you try to collect on this debt. Prove you acted reasonably and businesslike. Doesn't matter that he did not comply with the court order. Box/bag it and help him get it. We often deliver it to their new address or their mother's address as shown on the emergency contact info.

I'm guessing you changed the locks to get some revenge or to show him who's boss. Those motivations will only come back to bite you. --69.243.xxx.xx

It seems from reading this forum that in Maryland you can just pile his stuff out at the curb if you have an eviction order. Why not do that? You can't legally hold the stuff hostage for the money he owes you. Seems like you're confusing the two issues -- money owed and his stuff, which should be disposed of according to maryland law. Don't make the way you handle his stuff be a form of revenge for his bad acts -- that approach will come back to bite you. --70.143.xx.xxx

It seems that the LLS on this site give better advice than your attorney. If the judge gave the tenant two diff dates to remove his belongings, it sounds like you have to go back to court again and I can see why you are reluctant to do this. MD appears to be more consumer friendy and in your case pro tenant state and you are left with very few choices at this point. Choose your battles, this is costing you more than the tenant and your attorney is sucking you dry, stay from this attorney.

There was no eviction order because the tenant moved out at the expiration of the lease. I actually witnessed him moving out with a Uhaul truck parked on my lawn (not in the driveway like normal people). He moved before he was evicted. I'm not holding this junk hostage. But I do think that putting stuff on the back porch might be a great idea. Thanks to everyone. --70.161.xxx.xxx
