State Specific Question About: OREGON (OR)
I have a home that has been a rental and had a guy that occupied it intending to buy it contract of sale. He had poor credit and lost his job and left many utilities unpaid that were his responsibility as agreed. It was not til I contacted the garbage company to ask them to pick up his can and they refused because service had been stopped for non payment. They indicated his account was my responsibility as homeowner under contract of sale as well as rental. All other utilities by law cannot come back to home owner anymore....is garbage bill now my responsibility? I gave them his cell and his fathers number who agreed to pay bill if he didn't, but they won't bill him? Are they bullying me or do I have to pay his bill? When you are buying a home, the bank isn't responsible for your utilities. This doesn't seem right --76.105.xxx.xxx |

Also the garbage company if it is your responsibility should be informing you if there is a problem before an account is closed. I didn't know anything til I phoned to ask them to pick up his can he left behind. --76.105.xxx.xxx |

We have had this happened with two of our tenants. One was about $500 behind and the other about $700. We didn't think it was our responsibility, but according to some city ordinance it turned out to be our responsibility. Luckily one of the tenants paid off their bill and the other is still paying it off.
So if you know for sure that this is not required by state law, check if there is not a local law that might require you to be responsible for tenant's garbage bills. --24.6.xxx.xxx |

Well, I know we are required to make sure it is provided, but that is not the same thing as being responsible for another persons bills?? And if you are responsible it seems the garbage company would also have a responsibility to provide you with the ordinance and also copy of an default or intent to stop a service at that address. I thought the same way that logically a company would notify you of your responsibility and not let a person get $700 behind and wait years to contact you and let you know that there is this outstanding bill from your tenant that you're responsible for.

Portland metro has some separate rules from the ORS.. LL/statutes you should know about
Garbage is covered in there
ORS 90.320
(g) Except as otherwise provided by local ordinance or by written agreement between the landlord and the tenant, an adequate number of appropriate receptacles for garbage and rubbish in clean condition and good repair at the time of the commencement of the rental agreement, and the landlord shall provide and maintain appropriate serviceable receptacles thereafter and arrange for their removal;

So this means if I have a written agreement that they are responsible for garbage that I am not responsible for the bill, but just that I make sure its being removed??

I've had another tenant leave behind a washer, so know how to do an abandonment notification, but never had someone not return the keys. What is necessary in that instance legally. If they gave 30 days can I just change the locks or because I gave him a checkout list and indication that he is still on the clock until the keys are turned in, do I have to give separate notification before repossesing my property? --76.105.xxx.xxx |

The way I am reading it is if LL has/had a written agreement with tenant that tenant is responsible, then LL is not responsible. Otherwise if there is nothing in writing then LL is responsible.

Collecting on the debts will make you crazy, when the tenant signs the lease call to turn them out of your name, I read the meters and it goes on the move-in report so there is no funny stuff. When you do a purchase option this is why the option fee needs to be 18 months rent or more to cover these costs, foreclosure takes a long time to settle and expenses never quit. --66.72.xxx.xxx |

Well I've called to take them out of my name, but they still keep you as the homeowner regardless if occupant is paying the utilities as agreed. They make both of you call. A bank would not have to pay the utilities if they were holding the loan, so why would that be the case in a contract of sale. just doesn't seem like the correct info and just the garbage company bullying me because they want to be paid. Think I have that one answered, but want to know what the procedure is if someone leaves and does not return the keys. --76.105.xxx.xxx |

If it was a rent2own contract drawn poorly you have to foreclose and this will take a long time to get thru the court, this is where the option fee will get used up to carry the costs for 12-18 months till settled. --66.72.xxx.xxx |

So you have to provide garbage service when it is vacant too?? even though I've been a customer for 20 years and never missed a payment or been late, and another 2 1/2 w/ rental house w/ no problems, they are just treating you like a criminal when it was occupant who didn't pay the bill and they never informed me til I found it out myself. --76.105.xxx.xxx |
