State Specific Question About: GEORGIA (GA)

This may be a few questions, but here goes. I issued a pay or quit notice today. My tenant is supposed to move tomorrow. If they do, how do I collect the money owed? Continue to the same courts as the eviction filing, or go to civil court?

You need to go to small claims court and sue for damages and or money owed. Small claims and the court used for evictions are both civil rather than criminal courts ( at least they are here ). --70.248.xxx.xxx

In Georgia both evictions and claims for owed money up to $25,000 are handled in Magistrates Court (our version of Small Claims Court).

You don't have to wait till they're gone but it would be to your advantage because it will give you a chance to do a final accounting so you'll know exactly what it is they owe you. --70.248.xxx.xxx

Collection services often require documentation of a court order that the tenant has been sued and that the landlord has won the judgement.

Have they paid previous rent by check? If so, did you take notice of their bank and account number (it's on the check). If so, and you win your judgement, bank garnishment is one option.

They paid cash first, then by check. They bounced, account closed. I'm assuming I'll have to go to court either way, whether it's for the disp, or civil to get the money. The bounced checks and non payment are the reasons for eviction. --24.98.xxx.xx

If they wrote you a bad check they are still responsible for paying for it. You need to check out GA bad check laws if you haven't already. Anything over $500 I believe is a felony.

I had one write me a bad check for rent, she ended up going to jail and then still had to pay me restitution.

i used zabasearch.com to find someone recently.maybe wait a month or so after they move. there are other ways too.we get this question about once a week.look for other answers here.a colleague waited till bad guy got out of jail then collected by capias. --208.58.x.xx
