State Specific Question About: VIRGINIA (VA)

I have a good tenant 8 months into a 1 yr lease. She's been separated and now they want to give it another try and the husband wants to move in.

Not sure why Wallace mentioned Sec8 unless you posted in another thread. Anyway, as long as they are a good tenant and have a good credit/rental history it is to your advantage to add them to the lease, because it adds an additional person responsible for the lease and besides they are going to be living there anyway.

If things don't work out, he will still be responsible for the rent payment.

Because they are still married, he is legally already "on the lease" - basically she signed for "the marriage". If they have an actual "legal separation", I'm not sure how leases play into that. The term "separated" is used VERY loosely. It could just mean he was shacked up with another woman for a while and that girlie kicked him out.

In real life, he's going to be there whether you authorize it or not. Use this to your advantage by taking an application ("EVERYBODY fills out an app") and adding him with a simple letter and BOTH their signatures.

You now have info on him AND can garnish HIS wages if needed.

Personally, I am lenient (without being naive) when people are trying to get their lives together, especially a marriage.

EVICT BOTH... Send them on their marry way.

BRAD is right, you can't stop married people from living together. Sad part is once, the other deadbeat is in, HE is never leaving.

Call the Section 8 office, and see if you can get him added to her account, or removed...

Also, Call Section 8, and ask what happens when he get her all mad an she wants to evict her husband.

Finally, check to make sure wife doesn't have a protection order, against hubby... sometimes section 8 can deny you payment for allowing them to live together.

ALSO, get what ever SECTION 8 says in writing on LETTERHEAD.
