State Specific Question About: MARYLAND (MD)

My tenant put ashes from the fireplace into a trashcan on the above ground deck and it caught fire damaging the deck. 6 of the 16 boards will need to replaced along with 3 railings, the deck is 30 years old. I don't know what is fair and reasonable to charge the tenant. I am thinking I should replace all 16 boards of the deck to keep it looking decent but don't believe I should charge the tenant for a new deck - although if this had not happened I would not have had to do anything to the deck. I am also wondering if their tenant insurance will cover this. I appreciate whatever advise you can give me. - Marion

No the tenants insurance will not cover it, since the useful life of the deck is over.

I would not count on seeing one dime from the tenant unless it is given to you

My 30 years old carpet got a cigarette burn on it, and I want you to replace it, because you dropped the cigarette...

Put some wood filler on it and paint it....or replace a few boards, they do rot.

I agree with pmh, make yourself whole with a deck, hardly ever do auto body shops weld on used body parts, bolt on a door maybe, get a repair estimate and advise them either them or their insurance is going to repair this and you will not split the deductible either. --66.72.xxx.xxx

Things like this just do not "happen". Handling hot ashes is one way to start a fire. Think physics, how hot these ashed had to be...

It's the condition of the deck that counts, not its age. They DO have renters' insurance?

Not sure you can get more than the actual damage replaced, then sand and paint the whole thing so as to make it look less uneven. Good luck! --125.25.x.xx

Agree with pmh. That isn't wear and tear nor is it the life use of a item. That is tenant neglegence and damage.

Tenant pays for the whole deck.
