State Specific Question About: NEW YORK (NY)
In NYC I rented a 1 bedroom apartment to a single guy with a lease. I seems he has many friends who have keys to his apartment and they are there everyday. These people leave in the morning and return at night. It sure seems like he's is running a boarding house with my apartment. Every time I've gone into the apartment there's no evidence of this.
What is the law regarding who he can give keys to or what my rights as a landlord in regards to this.

I doubt that you will find any specific laws to help you.
You can however, send him a cure or quit, citing frequent & additional and unauthorized tenants...to give him a warning to kick all of them out or you will fall back on legal eviction process to kick all of them out...chances are...you will have to do this... --96.239.xxx.xx |

I don't know of any law that prohibits him giving keys to friends so they can let themselves in.
I would not send a Notice To Cure Or Quit without proof that he has unauthorized residents. Otherwise, you are putting yourself in an untenable position.
Let's say you send the notice, and he does nothing. What do you do next? Do you try to evicit? Where is your proof of a breach? You will be laughed out of court, and the subject will then be "res judicata," already decided against you.
If you send the notice, and he does nothing, and you do nothing, you have (arguably) acquiesced in his having multiple co-tenants who are not on the lease.
For you to do anything without the proof seems to me to be a dangerous course of action.
And you might be helping him establish a retaliatory eviction defense for any future eviction you might need to do.
I would sit tight until I could prove a breach.

Wow, that is some tough clause.
So you are saying, if mom or dad comes for a visit and tenant works, parent have to leave while he/she is at work.

Thanks for all that responded to my question. Your answers confirmed my suspicion that there isn't an easy way around this. I'll have to wait for evidence of wrong doing or just take his money every month and be happy.

A late entry from me, sit there and ask who is going into my tenants place, another way to find stacking is visit the restroom and count the toothbrushes, ask the tenant if they are not here overnight why do they need this, send a friend over to ask the census question - how many people are living here? --66.72.xxx.xxx |
