State Specific Question About: GEORGIA (GA)

Tenant did noy paid rent for four months. Optain Dispossessory Warrant. Tenant counter claim, landlord failed repair the property. i.e. front and rear steps, ceiling leak in second bed room. Tenant optain one written estimate of $850.00. Tenant Repaired front step by adding 2" X 6" wood to existing 3th level step, added 1" x 4" wood the back side of all others. Rear steps added 1" x 4" wood on back side of all steps and cardboard on the out side of steps to enclose them. Then painted cardboard, rear steps, rear porch, front steps and front porch all a discolorful orange. Paint spills remain on front and rear porch walls. Judment: Tenant did not give landload proper notice of said repairs. However the repairs problem needed to be made, therefore credit was giving to tenant. Tenant moves. The front steps are now a safety hazard and requires complete replacement, rear steps in repair from poor workmenship by tenant, front and rear porch paint needs to stripped and retain. Question: Can I deduct the cost of these repairs from tenant depoist and where may I find some referance material for support. --24.98.xx.xxx

The tenant counter claim should have stated why tenant was witholding rent. It would have stated:

You should have taken photos of the porches to bring to court with you. The photos would have shown shoddy complettion.

The judge ruled that the tenant's claim was good and credited tenant rent arrears. So I would say no, you cannot charge for shoddy work because the judge aready ruled. You probably would end up in court again with that same judge who would say you should have taken photos of the shoddy work and esthetic damage to bring to court in the first place. --70.189.xx.xxx
