State Specific Question About: SOUTH CAROLINA (SC)

I am having a terrible time with our property manager. They are doing nothing they said they would do and I don't know enough about rentals (this is our first time renting out a home)to be able to hold their feet to the fire. Is there anything I can do? --98.25.x.xxx

Look at the contract you have with them and if they aren't doing what's setforth in the contract notify tem in writing wwith a date by which you expect it to be done. if after that date either cancel their services or there's always SC Court. --69.155.xx.xxx

There have been several issues, but the main ones are that the renters have consistantly paid late for almost every month and were never charged any of the late fees listed, and when they finally got caught up and wanted to pay early for April the prop manager said she would still not send out the check until the 10th of April because "that is when she processes checks for the month of April per our lease agreement". So regardless of them paying early we are still getting our money late. --98.25.x.xxx

I see this as a common issue with property owners who never managed property themselves before handing it over to someone else. We don't know your area, but maybe good paying tenants are really hard to get. Maybe your contract states that you get paid on the 10th (I do with my PM). There are a lot of unknowns to determine if this is really a bad PM or not. Bottom line, if you don't like dealing with them then read your contract for a way to get out of it. Then I recommend that you manage the property yourself for at least a year before giving it to another PM. Otherwise, you'll never really know if the new PM is going a good job or not. --74.8.xx.x

I run a PM company. Before passing judgment on your PM, I would be curious what your agreement with them says regarding late fees charged and collected and regarding payments to owners.

If it says you will be paid on the 10th, then it's not really an issue. If the PM processes all their accounts and issues checks on the 10th, then I wouldn't expect them to deviate from that.

If the PM should be collecting late fees and passing them on to you, then I would simply email them with your questions and come back here with their response. We'll let you know if they are being reasonable. --68.90.xxx.xxx

Like it was mentioned, if your contract says you'll be paid on the 10th, then you'll be paid on the 10th.

If your PM has to chase the rent every month, that is above and beyond for PM fees and THEY should be charging fees and keeping those fees. --174.156.xx.xxx

As far as the late fees, they are supposed to charge them and keep them. I don't care that we don't get the money for late fees, but these people have gone 15 to 20 days late every month and the PM has never done anything about it. When they finally were over 30 days late one time we had to tell them that we wanted to start an eviction (which of coarse we would pay for) and they still didn't want to do that. The lease states that they process checks on the 10th and the 20th of every month. The guy finally paid early for April on Mar 15 (cash)and the PM said they were still going to hold the check until April 10th. Maybe that is standard procedure but seeing how much we have already been through with these people I didn't see any reason why they couldn't process it on the 20th. This was something we had to rent out because we couldn't sell it and so it's not like we have alot of reserves to cover when we get paid late and they know that. I felt like they were just giving us a hard time because we were upset they weren't doing anything about the tenants late payments in the first place. --98.25.x.xxx

If the PM is not charging the late fees, then the PM may be doing you a favor. If the tenant is struggling to pay, and the PM is forgiving the late fees (that would go to him, not you, per your agreement), then the PM is helping keep your tenant in the property and allowing all the money to go to you.

Having said that, you and your PM should never let the tenant get 30 days behind.

I don't agree with everything your PM is doing, but he doesn't sound "terrible". --70.129.xxx.xxx
