State Specific Question About: NEW JERSEY (NJ)
I have a tenant (husband, wife, and 2 children)on a one-year lease. My lease stipulates that overnight guests are not permitted without the prior written authorization of the Landlord. It further states that an overnight guests is anyone not named in the Lease as a tenant. My current tenant has has a family of 3 stay for almost two weeks in Nov, then in March they had another guest for 10 days. They currently have another guest going on two weeks now. I know I can send a notice to quit, but if they ignore and I need to take to court, what are my chances in Court. Supposedly all these guests are family (nieces or nephews). Why not send them a bill, since you are running a motel.
Sounds like they are having guest in town for a few days.
This is a two way street, and I'll be the Building Inspector can find a few violations...

No overnight guests is a little tough, I'd move out if my landlord told me my family from out of state couldn't stay with me when they came to visit for a week or two. I had a young newly married couple in my rental last year whose father showed up with a motorhome camper to visit them right after they had a baby. What am I going to do, tell them he can't visit? This is mostly costing you on your water bill.
It's hard to prove this in court without witnesses. If this were my problem I would check my next water bill and compare it to other water bills when there were no guests.
I would then raise the rent in the amount of extra water. Divide it by 12 and spread it over the year. It's hard to find tenants right now. If they are paying then you want to work around this problem in a clever way and they won't realize what you are doing! --76.99.xxx.xx |

If this is a SFH I think that "No overnight Guesses" is a little intrusive. Under that rule the kids can't even have a buddy spend the night. That makes it almost unenforceable IMO. I agree with IN and NE if they pay the rent and take care of the place that's Good with Me. --69.155.xx.xxx |

In a SFH yep family is going to come visit. It seems you are watching your tenants awfully close to know exactly how long their visitors are staying. I agree that it's extreme - especially if they are taking care of the house.
This is a transient world, and family - especially grandparents - will come and visit for weeks at a time.
And if the tenants are from another country, chances are that family will visit for months at a time.
If you are paying the water bill, then you can inform them that there has been an unusual increase in water usage, the rent was established for a SFH, and if they are going to have guests for more than three nights, you will have to increase the rent by $25 per month or $5/day (something reasonable) during those months.
If you are paying all utilities, then you need to set up a fair reimbursement for the extra usage.

I would be concerned with an unapproved person moving in and taking occupancy with a tenant, but like others, if my tenant pays and takes care of the dwelling, then I don't mind if they have guests for a few weeks. Especially here in Alaska, I am certain that I have tenants with older children out of state who may be up here for 2-3 months over the summer (college students, etc). I know they'll be going back to school in the fall, so why make a big deal out if it? Few people come up here to visit and only stay a few days anyway; it's too far and too expensive.
That being said, I do have a clause that guests staying over 15 days wihtout prior consent is a breach of lease. I consider myself to be a fairly hands-off landlord, but I expect to be informed of things such as guests, going out of town for long periods of time, and - of course - maintenance issues. I make sure each of my tenants knows this. The clause stays, however, in the chance that I have a problem tenant then I can use the clause to protect myself and the property. --158.145.xxx.xx |

I never understood why some people don't want their Tenants to have overnight guests.
People like to have guests over, there is nothing wrong with this, unless they move in permanantly or for a long period of time. If this happens, then put them on the lease. ( If they check out ok )

I don`t understand why you would ever put that in your lease. I understand not wanting tenants to have unauthorized people essentially move in to the unit or even stay for weeks on end. But, you say not even one night?!?! You`re their landlord, not their mother. I guess they agreed to it so it`s their problem, but I would never, ever, ever willingly agree to something like that, and I cannot for the life of me understand the rationale behind it. My overnight guest policy is certainly not unique, many apartment complexes have this policy. I do not mind an occasional overnight guest for a weekend, but when a tenant repeatedly has guests for weeks at a time, it's a problem. It's in my lease precisely to control that additional unqualifed tenants do not "move in". If I qualifed 4 tenants to live in the premises, there should not be more than that living there. A tenant who has a so called guest for a month, that is not a guest. --173.54.x.xxx |

My lease allows short stays(5 days in a 3 week period), else per day charge is $20 per person.
I don't enforce this unless it seems like it is abused and someone has basically moved in. If you are paying utilities and it is costing you money, then you may want to enforce this more carefully. But otherwise, not really worth your time or effort.
