State Specific Question About: VIRGINIA (VA)

A lease agreement for a condo unit is ending on 31 Mar 10. According to the Lease agreement a 60 days notice is required to vacate or continue the lease. I sent a notice to my tenant about 60 days in advance but have not heard from him as yet. I then tried to reach him and found out that no one is living at the unit. I also learnt that the tenant is out of country. All of his household belongings are still in the unit and I do not have any contact with him. In order to market the unit for further renting, I need to have access to the unit. If I do not rent it intime there is a big amount of condo fee which I have to pay to the management company. Kindly advise what should I do under this situation.

send tenant a letter - maybe mail is being forwarded. If he's out of the country and still paying rent, and has not given notice, then I would assume that he plans to stay.

Does the lease say 60-days notice or the lease renews? treat him like an M2M until you hear from him. he is responsible for April rent at this point b/c he did not inform you of intent to dissolve the lease, nor did he comply with making the property available so you could rerent it (assuming that's in your lease)

go back to the application, find his employer or emergency contact (if you don't have one on your applications, add that for the future) and call these people to get a message to him.

If you do not rent it in time--for what? Are you just trying avoid paying one month's condo HOA fee out of your pocket? I have a condo I rent out. I always keep the HOA fee separate from the rent.I pay the condo fee every month myself--automatically out of my checking acct. ThenI 'pay myself back' when the rent comes in. Do I sometimes end up paying out of pocket when no money comes in(like during turnover) YES I do. But that is part of being a LL. And paying it on time is better then paying late, waiting on a tenant--and incurring a late fee of $50+. The way it was explained to me is HOAa just love when fees get paid late because they are slavering to get the additional late fees they charge.

If you need access to the condo, you can enter for 'periodic maintenance' if you post a 24 hr notification on his door that you will enter the next day. Go thru the motions of checking the AC filters and the smoke alarm batteries, and then you can gage if this tenant looks like he is moving. Did he even get your notice of non-renewal? Any packing boxes? Is the fridge all cleaned out of perishables? Do neighbors on either side or above/below know when he left or is coming back?

If you can' get any new info on the situation from any avenue, you may have to sit tight for 30 days till you can exercize abandonment laws. IF that means paying the condo fee--so be it. Charge him full late as soon as you find him. --137.242.x.xx
