State Specific Question About: GEORGIA (GA)
Renter is breaking lease two months early. Did not tell my property manager. A shower leak was addressed several months back and resolved. A "mold" in shower was called in. The renter did not return calls or respond to email to allow us back into house to look a shower. The renter did say we are out of town, will call when we get back. We followed up with calls and emails. Renter called to look at leak that he found while moving out. The renter feels like he has a right to break his lease and get security deposit back. My property manager is checking with an attorney. Any feedback? --98.92.xxx.xxx |

This is Georgia; hot and humid. Mold should be the state flower, especially in moist places like a bathroom.

I would not give the tenant their full deposit back. You can't be held liable for the problem if the tenant wouldn't let you in to fix it.
In the future, give proper notice and go fix the problem. If small problems are addressed they turn into big problems. --66.240.xx.xxx |

Would not have a problem giving security deposit back but I want the two months rent left in the lease. Now, if the house rents out next month, I am fine with one month. I am not greedy, Just don't want to get screwed over by renters. They provided my property manager photo's of the house a week before they moved in. Luckily, we had photo's the day before they moved in but they had already cried their sad story to my property manager about the condition of the house upon moving in. --98.92.xxx.xxx |

I would try to rerent property ASAP-- as the LL you are required to mitigate the tenants damages. (be sure to include your advertising costs.
Send them the bill for the remainder of the lease contract and the damages letter from your walk through. Take pictures. Should you rerent the property send a new bill showing you have deducted the new tenants payment to you from what the skipper was billed.
mold in shower---- you cannot be responcible for tenants not cleaning the tub properly after use. (when you take pix's be sure to high light the filth through out the home. all renters feel they have a right to break their leases-- that's when you have to step up and let them know-- who the owner is and who the renter is. --74.184.xxx.xx |
