State Specific Question About: MARYLAND (MD)

We have tenant who consistently pay late. The tenant pays on ~ the 17th or 19th each month. (does include $50 late fee) Rent only on time twice since move in in July 2009

The grace period per the county is the 10th. We give until the 15th before we file the failure to pay rent with the county (costs $15)

What should we do? She doesn't seem to care about being served monthly. she just pays prior to the court date.

To make things worse, we went over to check on a repair and she had all new furniture (she is just not putting the rent as priority.

Any ideas???

I don't know what your laws are in MD. In Nevada if you are month to month you can be given 30 days notice for any reason. I'm not sure you can charge additional fees if it is not in your original contract. So it really depends on your laws and your level of comfort. If you are just tired of dealing with the late fees,pay and quit every month, then serve her notice if you are able. OR some may suggest giving her a different due date for her rent. if VA if the tenant pays in court then the tenant stays. However, the 2nd time in a one year period the landlord can still get poss. even if the tenant pays. I would send notice on the 10th or whatever is the earliest you can. I would go to court instead of nonsuiting the case. I never understood the wisdom of a "flat rate" late fee where if the tenant is going to be late, it doesn't matter if they're 5 days or 25 days the fee is the same. I write my agreements at so much per day penalty from the first, which applies if paid after the fifth... --76.108.xxx.xxx

When the lease expires, change the terms of your late fee. Charge the maximum the state allows. Charge a fee for filing in court ($15 + your hassle). here's why you can't do the $8 or $10 a day --- because the judges will throw it out as excessive.

This is what we have learned over the years-- do $8.00 per day up to 10 days--OR 10% of the rental amount after that. There aren't to many judges out there that will allow the 10 per day for 45 or 60 days etc..

If you come into court with a reasonable amount-- you won't look like the greedy LL with excessive fees.

I charge a $75.00 late fee. I have a couple tenants that have been with me for years who routinly pay late. Always pay, just late with a late fee and any other charges. I don't complain. But I can afford to risk it. At this point even if they do end up not paying and I do have to evict, I have more than made up for the months rent I would be out. In fact at this point one has paid for 3 months rent in late fees. Plus I have a security deposit.

You just have to decide if you want to risk it. It can work out to your advantage. Pays well when it does, but can hurt a wallet when it doesn't. --96.225.xxx.xxx

I charge $5/day for my cheaper units, and $10/day for my more expensive ones as a late fee.

So far, it has never been questioned in court. I have collected late fees at least 4 times from a court order using this method.

We charge a $ 50.00 late fee, for anyone who pays after the 5th of the month. We have one Tenant who pays late every single month. Actually, we go over every 2 weeks to pick up the rent. It really doesn't bother me to get an extra $ 50.00 every month & she keeps the place clean, knowing we will be over every other week.

MYOB is right. In Georgia there is no limit on the late fees which can be charged as long as they are spelled out in the lease agreement and the tenant agrees to them. In most states which don't have limits, it's the same way.

Of course this does not mean that it will be enforced by the judge. While daily late fees can be charged, most judges look at them as excessive and view the landlord as greedy. --99.4.xxx.xxx

In NC, the Late Fee is 5% Maximum - Changed ONCE. And the Security Deposit can be no more than two months rent if it's an Annual lease, less if it's month to month or weekly.

They expect you to file and evict, I guess, rather than charge excessive late fees.

In Montgomery & Howard Co. you can file for eviction on the 2nd, you just can not collect a late fee until the 10th. Also the 4th time (in a 12 month period) they are late & you have filed (the 2nd of the month) you can file for eviction/posession, even if they pay the rent. --173.79.xx.xxx

My thoughts - enjoy the extra $50/month. I'm not going to figure it, but I bet the APR on that is pretty high. Start budgeting that it's going to be late all the time, and maybe even wait a little longer to file.
