State Specific Question About: WASHINGTON (WA)

we rented out our house in Sept. The carpet was in good shape (older then 7 years though). The brought one dog in that was on the lease. However they brought a second dog in with out our consent. The dogs started peeing on everything the carpet was ruined. Then the tenents started trying to clean it with muliple cleaners. After only being there for five months the carpet is unsavable. Its going to cost us 4000.00 to replace the whole house. Can we keep the 1400.00 deposit to help with the cost? --71.80.xxx.xx

I think you can keep the deposit but only the actual amount it takes it repair the damage. You should also charge him back fees/rent for the extra dog. --216.82.xxx.xx

Well 1st.. check your WA statutes..

Typically with carpet that you believe is ruined..

have a cleaner come and write a report as well as clean... so they get paid..

you may keep the amount of reasonable restorative efforts..

For replacement..

the original value you'll need to prove or have a resonable value for..

then reduce the value by perhaps 1/2 or more... then apply it to the damages area..

you can see this method is no very good for getting any money..

if you go to court it is a crap shoot.. but they have to persue you.. and not too many folks want to do that for the amount --207.200.xxx.xx

I am sorry that my dog pee tenants moved into your rental and ruined all your carpet too. What is it with these tenants that let their animals poo all around the house? Hello?

I would certainly keep their deposit. If they want it back, make them fight for it. Take lots of pictures.

Old or not it is ruined carpet, take photos of damages and mail out a accounting statement with a few photos included for the deductions, which regardless of 1, 2 or more pets the carpet and padding is not reusable, cut out some samples and save for court, when the judge pulls it out of the bag the hammer will drop in your favor, if it even goes to court. --76.241.xxx.xxx

I don't know about WA or MD (Jackie's state), but in the two jurisdictions I know of, the landlord can keep the deposit, and account for it. The tenant has to file a lawsuit if they disagree with the landlord's retention of funds -- then the judge will decide.
