State Specific Question About: NORTH CAROLINA (NC)

If a handicapped tenant gives notice to vacate (30 to 45 days) but does not pay the current rent, can that party be evicted sooner because of non-payment of rent?

Are the eviction laws different for handicapped people in NC?

Notice to vacate must always be written. In my rental agreement. Security deposit cannot be used as last months rent in my rental agreement and both require initialing.

My 30 day notice to vacate that is included with the rental agreement pkg has the ca code# for security deposit laws which include, you guessed it....Security deposit cannot be used as last months rent.

My acknowledgement of 30 day notice to vacate has the prorated amount of last months rent as we are a 30 day from the date of submit state. As well as offering a pre-move-out inspection=CA weird pita law.

Again it states that:"Security deposit cannot be used as last months rent."

Make your forms do the work for you. I get no sitches like this since I've been using forms that work with each other.

There is a myth that new landlords listen to about no eviction for mom with kids, cold weather, on fixed income, unwed father with custody or hard of hearing - when the rent is not paid they are all subject to the same standards in filing a 3, 5 or 10 day cure/quit which means that you put them on written notice to pay or the eviction will be filed. Wherever you hear that story tell them I will let the judge make that ruling after you explain it for her/him. --99.160.xx.xxx

In some states, the disabled have more rights than the typical tenant. Usually, they get more time for a no-fault notice to quit. They don't get a no pay or for cause exception. Another thing I have seen and do not understand is that some judges will void a 30 day if a notice to pay or quit is served. I don't know if any of this applies to NC.

What I do know is that a tenant can waive the pay or quit notice if it's the rental agreement, which means you can go directly to court without serving the pay or quit notice. Non-payment is always the easiest way to get someone out. --70.22.xxx.xxx
