State Specific Question About: DELAWARE (DE)

Need your help again. We finally got the tenant out and there was damage to the unit. Sent out a letter, however, husband forgot to put in the check. Realized that it was forgotten but it was mailed 4 days (20 days) mailed it on 24 days. Very bad weather where we are and very bad weather in Delaware. Tenant is disputing everything except for a few things. Not taking responsibilty for anything. We are now writing a letter to try and resolve this and reducing the prices of some of the charges. If we were able to clean and get back some of the damages, however, some cannot come out. What do we do now? The townhouse was brand new and never lived in. Thanks, Sue Ann

If you have already issued a list of damages and a check for the balance, I would wait until they send me something in writing before doing anything further.

If you tenant is not happy they have the option of taking you to court. You have the same option.

In MA we are required to have a statement of condition detailing the unit's condition at initial move in. Unless you have something to show the actual condition when they moved in they can always say that it was preexisting.

Hi,thanks, she did send a letter, detailing everything single thing we thought was not properly cleaned and/or damage, we have pictures of the unit in the brand new condition and then we took pictures of all the damages/repairs. Our only mistake was not sending out the check in 20 days, rather it was sent in 24 days. Any other advice. Thanks. --64.12.xxx.xxx

Tell the tenant all communication must be in writing,

You have sent a letter and documented your case, also you should not have noted a the additional check in your communication.

What you say or write can be used against you in court.

I's just said here is a list of some things we forget, with no mention of the check.

I would stop all communication with the tenant. They want to take you to court let them. Make no more letters or calls. It is not if the counter comes clean,it is they did not leave it clean....Someone has to clean it.If you took out for damages,that is it.I do not know what the law is for returning security in your state,regardless though I would not send them an additional check or communicate further.If they really want to dispute,it will go to court on their dime. --174.55.xxx.xx

First, because we did not send the check in on time 4 days late, We have 20 days and if it goes to court the judge could award double security. We live in NJ and have this place in Delaware. I did not see the damage until after the letter was written and depended on pictures from my husband (who was quite mad) and Agent. And when I started working on things, some of the damage/repair did come back after much labor. the law is that if things come back after painting and ordinary cleaning they are not considered damage.
