I have family who live in my home and of which I am on the deed. I feel the 3rd party listed on the deed will not allow her mother and father, who are the current tenants to have to pay the rent. I want to enter into a contract that binds them to have to pay the monthly rent due on or before a certain date in the month or they must vacate the property. Is there such a contract? And if so, how may I obtain this? This contract must also bind them to clean and repair any damages caused to the house. Is there an contract we can get made up, notarized and set into motion so as to keep the house in good standing. lesson here: never rent to family???? State Specific Question About: ARIZONA (AZ)

In some States you can not evict or make a co-owner pay rent. If the family living in the home isn't paying rent, then you want to change the terms of their tenancy, you need to consult with the local real estate laws. --98.119.xxx.xx

Frankly, I understand that there are things I do not understand. "my home" indicates your name is alone on the deed. Or is it "their home", too when it comes to fractional ownership?

Once a realtor urged me to bid on a valuable SFH where a fractional part was going to court auction. i would see a real estate attorney and do whatever it takes to separate "my home" from "their home". Forget contracts, you will only be miserable and fighting all the time... --125.27.xx.xxx

If there are more than one owner you Owners need to get together and get on the same page.Barring that petition the court for an equitable distribution of funds which will force the sale of the place . maybe then you can buy it outright and not have these problems . --70.244.xxx.xx

I know the best thing to do is consult with the 3rd owner- ( the tenants daughter) and get on the same page.. the 3rd owner being the one who totally agrees to the terms. Percentage of ownership = ? So the maybe 1/3 guys like their parents to use the house rent free 3/3 or 100%? Makes sense! Me first, screw the others, nothing new here.
