State Specific Question About: OREGON (OR)

One of our tenant is 2 months past due in rent. We have accomodated very late payments for 6-8 months. We have now served him with 72-hour eviction notice. He has stopped by the property management office to make partial payments. My property manager tells me that after giving eviction notice, they cannot take partial payment as that would void the notice. I have told property manager not to turn down any payment. My instruction to property manager is to take all partial payments and send new 72-hour eviction notice. What does the OR law/rules say about partial rent payment after eviction notice? --15.251.xxx.xx

Here in Ks you can accept partial payment with disclaimer that you are not giving up your right to continue your action. Only if past due amount is paid in full do you then have to cancel your action against the person. --70.244.xxx.xx

What does the lease say about payments on an old account, should first go towards the late fee then rent, if this is legal at your local courthouse this begs the question why wait 4 months of late to decide eviction is a good idea? --68.76.xxx.xxx

I was told by the Housing Service in Corvallis N0T to take any $ or it will void the eviction. BUT there is a certain form that can be used, although Housing Services has only heard of it. I've never seen it either.

Recently I refused to take $ from my tenant - and all of a sudden he saw that buying time in the rental house is actually a privilege. 0ne that he had lost. We were able to settle, [ie- he found the full amount due] but he had a major attitude adjustment by me not accepting that partial payment.

I should have read your post more carefully. With a 72 hour notice the tenant does have a period of time to either come up with the money or move out. Minimum 72 hours - the count down starts at 12:01am on the day after the notice is served. During that time we have to take payments, but if the total is not accumulated by pumpkin hour- then we don't have to take any more. Problem with that is that it makes us look bad in court.

But in your case - 2 months overdue - you don't have to worry about looking bad in court.

Does the tenant have an income tax refund coming that he can have direct deposited into your account? --12.73.x.xxx
