State Specific Question About: TENNESSEE (TN)

I have a tenant that her lease is up the first of April and she has turned her 30 day notice in on the 5th of Feb. The problem is in Dec I asked that she removed her dog from the property due to him not being house broken, He has ruined carpet and hard woods floor due to the urine. The house smell like a kennel. The kitchen floors also need to be replace due to the dog peeing on the stove and washer and it not being cleaned up for days, I am not just talking about urine, The urine has ran down the app's and has gone under the floor, The tenant is goes for days at a time and leaves the dog in the house free to run and do what ever he likes, Do I have the right to make the tenant pay to fix, clean or replace what is messed up? And does she have to pay for March rent (she will be moving by the 8th) but her lease is not up until the 1st of April? --74.170.xx.xx

I'd suggest you prepare your paperwork now for the civil suit for damages and breach of contract. File the complaint for the maximum small claims dollar amount with the court. You'll have time to get astimates between then and your court date. You will be awarded only the amount you are able to prove. Use a private process server who will serve your tenant at the time and place of YOUR choosing, namely as they're loading up the truck and thinking they've put one over on you...They have to show in court, or you win a default judgement. --76.108.xxx.xxx

It is best to use damage photos after they have moved out all food, furniture and packages including the garbage bags of stuff, whatever is left for you you can charge cleaning fees, floor repairs and then get the new address to send the accounting statement and refund - from the sound of it there will not be much of a refund, so act quickly for the lawsuit to recover the unit and the second half of law suit for damage award based on the move-out photos, the better they clean up and clean out the more they get back - do a search here for eviction to get the basics but if not familiar then use a lawyer flat-fee service, here we pay about 350-400bux for both halves including court but I make 3 copies of everything and take to lawyer office to save time for them. --68.76.xxx.xxx

Geez, that is nasty, take pictures, lots of pictures and yes she is responsible for damages.

I met a possible tenant once and had her bring her dog, he peed in the living room immediately, she did not get the rental. --209.42.xxx.xx

Yes you have a right to sue the tenant for the damages caused by the tenant and the tenant’s dog; Note: A judgment against the tenant does not mean you will ever collect; hopefully you have a tenant who has a steady job, some assets, and cares about their credit score; if not then you will be paying out of pocket to fix the rental, you will have a judgment , but you will have no actual monies in your pocket from the tenant only that little piece of paper i.e. the judgment worth about the cost of the paper if the tenant has no assets --68.82.xxx.xxx
