State Specific Question About: OREGON (OR)

There are 3 changes for 2010 Oregon landlord/tenant law that affect my 11 units. These are the smoking policy, list of fees, and flood plain. Do I need to amend my current rental agreements, or would this only affect agreements signed after Jan 1,2010? I reviewed the law, but it isn't clear to me. Thanks! --204.130.xxx.xxx

Hi Sparky....

Well the laws you mention, and thare are more than 3 changes to ORS 90..

Are in effect.. so that means they changed no matter what your agreement says..now the task is to change your method of opperation and your agreements by addendum to be in compliance...

No smoking is a policy change... fees need to be written etc.. but read them carefully.. there are as always openings that allow structure of documents to protect you.. such as you may now charge for your labor.. good luck --75.139.xxx.xx

New noncompliance fees defined:

• A noncompliance fee of up to

$50 may be charged to a tenant

for the following circumstances:

Late payment of utility or service

charge that the tenant owes the

landlord, Failure to clean up pet

waste, garbage or rubbish from

premises (other than dwelling

unit), parking violations and

improper use of vehicles within

Where are all of you located in Oregon? Not to hijack the thread, but I'm located in Hillsboro (NW of Portland) and have yet to buy a rental in the Portland metro area because I can't find one the meets the 1% rule. I have 19 units in South Dakota that bring in between 1.5%-2.2%. I'd love to find a rental locally, but only if the numbers make sense. Are any of you getting 1% in the Portland area?
