State Specific Question About: ARIZONA (AZ)

I am a LL that has a Property Management Company in AZ managing my rental property because I live in another state.

The PMC I hired is less than ethical or honest. They charged ex-tenants for replacement costs for damaged appliances and replacing cracked mirror closet doors, deducting the amount from the tenant’s security deposit.There was no other damage to the property. However, I have it in writing to the PMC that I would hire my own vendor to make repairs,so I could be certain repairs were actually completed. No more double billing both parties for jobs that were never done.

I asked for a copy of the Final Closing Statement given to the tenants. What I received was a “Revised” Tenants Closing Statement from PMC. It shows the cost of the damages deducted. Tenants security deposit was kept by PMC and tenants owed an additional small sum. No refund of their Security Deposit was issued to tenants.

Tenants were charged for damages.

However, PMC DID NOT do any of the repairs. They just kept all the money. LL had repairs done at my own expense/out of pocket.

Can LL ask the PMC for reimbursement for the repair costs I incurred to repair damages? We have a standard AZ Property Management Agreement nothing out of the ordinary in it. Any Advise greatly appreciated. --71.142.xxx.xxx

i think landlords shoyuld live within 30 minute drive of property so they can keep eagle eye on it.if u are not around it encourages people to take advantage.a few guys here do it well but i think average landlord should not own over 30 minute drive. --208.58.x.xx

Reid [KS]), RR78 [VA]), I too think it is stealing and I will follow your advice.

Virden [OH])LL had repairs done after tenants vacated property. It was all done within the legal time frame. Because of an abundance of SFH available in AZ at the moment, property sat empty for 3 months. I lowered the rent just under market($50) and it was rented with all repairs completed. PMC did not send me any refund for those repairs over the 3-month period however, it deducted its commission fee without fail!

billy [MA]) No point selling a house at a loss! Job relocation forced me to rent out property. It was NOT by choice that I moved to another state. Sometimes you do what you need to do especially in this economic downturn! The mortgage is completely covered by rent and I still make a small profit, while I wait like all the rest of us for the housing market to stabilize.

Thanks to all of you for your suggestions! I am going to send a letter today to the PMC and if I don't get a refund I'll take it up with a DA’s office, as I too feel that this PMC is stealing from me and other LLs in our area!

Any other thoughts are welcomed and appreciated especially how to manage my property at a distance without a reliable, honest PMC!
