If a tenant gives 30 days notice for moving out in the middle of the month, do you charge a full month's rent for the month that he/she moves out? For example, my tenant is moving out on Feb 20. Do I charge for all of February or only through the 20th? There is no proration clause in the lease. Any advice would be much appreciated!!

If they are on a month-to-month lease, then a 30 day notice can be given at any time. You would prorate the rent by dividing by 30, even if there were 31 or 29 days in the month. Be thankful, you then can fix up the unit and try to rent it for March 1st. Good luck. --98.119.xxx.xx

The term of a MTM lease is a month. The notification from the tenant is to terminate the next months automatic renewal of the MTM lease. There is no prorating unless you decide to operate that way. --209.68.xxx.xxx

You must offer a pre-move out inspection. CA State Law. You must supply a itemized written accounting of the security deposit. With receipts if SD deductions are $125 or more.

You must do this 21 days the day after you are given possession back via the keys.

This =could be= before Feb 20. CA State Law all of the above in this post.

Jen, it is a CA law.

Civil Code section 1946 requires pro-ration on a MTM. It provides in part:

"As to tenancies from month to month either of the parties may terminate the same by giving at least 30 days' written notice thereof AT ANY TIME and the rent shall be due and payable TO AND INCLUDING the date of termination." (Emphasis added.)
