How do I get rid of a tenant with a week to week lease?
they usually do pay within the week I'll usually get it maybe on the 6th day or so then have to start all over again for the next weeks rent. I've started eviction procedures 3x this year and they'll always pay on the day the notice to quit is up. So I suggested we go to a week to week lease which they jumped at. So now I have to go through this waiting for my rent on a weekly basis. They cause trouble with other tenants. When there unhappy about something (usually when I ask for the rent) they call and yell at me using foul language dropping the F bomb and threaten me with calling the state about code violations which there aren't any (the unit is cleared by section 9). I told them they need to move out I'll give them a month or two to find another unit but they need to start looking. There not looking anywhere.

Here in MD, after 3 late pays, we can go for eviction based on the late pays...
The link on this page does not work for NH State Laws..so you probably will need to find the statutes via Google...
Bear in mind that week to week can sometimes be different than MTM...good luck

Usually you give a notice of the same length as the rental term , in your case one week would be the minimum notice . So if as you said you'll give them a month you're being very generous . but the notice has to be in writing , dated and signed by you . be sure to keep a copy. If they don't move out by the time alloted then you have evict and for that you'll probably be wise to use an attorney. --70.244.xxx.xx

You might consider offering them cash for keys and the place left in good condition.
Find out the cost to file with the court, process server, lawyer if you need one, your time, etc. and come up with an amount that you would pay them to avoid having to go through the court to get them out.
I did it once and I was happy with the result. I think I gave them $150 to be out in one week with the place clean and undamaged. (It was clean to their standards, not mine, but good enough.) --162.39.xxx.xxx

i heard somewhere that you can terminate a lease when a tenant is X times late. Here, I would choose the long notice (30 or 60 days) and play the Pay or quit game one more time.
You need to get these people out -

send them a letter that all future communication must be in writing and never accept a call from them again
give them a proper and complete Demand and Eviction the day rent is due
go to court on the 8th day after and get them served
simple - follow through with your eviction and do not talke to them again.
Take your lumps now and get back the unit and then re-paint and re-rent in time for spring --75.68.xxx.xxx

if i have to send 14 day notices 5 times in a year i tell them i have to up on rent to cover cost of service.seems to work.i give notice before doing this say when i send the third notice.i would also tell them if they are unhappy here maybe they would be happy elsewhere.do u mean section 8 in your msg? --208.58.x.xx
