State Specific Question About: MISSISSIPPI (MS)

A property manager is handling my property. I want a complete copy of her files on the tenant. We are evicting next week and I feel the manager is hiding some info. I believe she is friends with the co-signer, and is not doing her job correctly. So my question is, Can I make the property manager give me a complete copy of her files? --98.219.xxx.xxx

The process is called discovery. Have you lawyer do it and hope the PM doesn't provide the information. You will have an easier time getting a judgment if they disobey a court order. You can also report them to the regulatory agency of your state (a long shot) or the AG's office (an even longer shot). --132.183.xx.xx

Bob, forget "discovery", "subpoenas", etc, the answer to your question is yes. Have you asked for it? If they have told you no, what is their reasoning?

But evictions are very straightforward, there is not much info to "hide". If the rent has not been paid, you will get a judgment 99.9% of the time. --68.90.xxx.xxx

Wallace and I both run management companies, as most frequent visitors to this site would know. So I always respect her opinion but I cannot see how a PM would not provide a copy of a lease to a property owner. To me, it contains no confidential information. As an owner, I would go ballistic if I could not get those. And it's typical that a bank requires copies of leases when a property is financed (we manage multifamily, which gets refi'd every 2-5 years).

Also, our leases are written between the tenant and the property owner. --70.246.xx.xxx
