State Specific Question About: MISSISSIPPI (MS)

I have a person in my home that out of good faith said she was going to purchase the home. Five years later she has not. I did not type up a contract until after the fact since she was eager to move in my home and I was ready to move into an apartment at the time. She has breached her contract in retrospect to 1.No pest control or 2. renter's insurance documents submitted to me and 3. the maintainence of lawn care is horrific with abandon vehicles, wagon, refrigerator, etc. My intent was to sell the home (still paying mortgage) so I am still stuck with it in my name. I gave her a final breach of contract notice Dec.24,2009. Afterwhich she now refuse to pay rent and says she will move out at the end of the month. This is always fun, you have to evict and foreclose, hope you have enough deposit to cover those expenses - most R2Own take a 8K deposit because legal fees can often cost over half that, these expenses your lawyer will pray as deductible in foreclosure suit, expect about 4-6 months for hearing on foreclosure and at least 2 more for unlawful detainer. --76.241.xxx.xxx

How much was her down payment? Is she mentally ill? The junk and bizarre behavior indicates it.

Is she collectible? I would hire an eviction law firm, not a Jack of all Trades!

foreclosures locally cost @$2k...., but i do get a volume discount..., so i'd say locally if one shops it could be $2 to 3.5k; any more your overpaying- but millage will vary...

the issue is if they have an equity interest.... LOCALLY..., if a rent to own option is even HINTED (dont mention) then the eviction is dismissed and one has to do a full foreclosure.... so if you go this route only present your lease, only discuss lease, and pray they don't show or mention the equity ownership part.... BIG GAMBLE...

Here if the local DJ finds it is a rent to own, it gets throw out and then needs to be taken to the county level. The county level is slower and a ll probably needs an attorney for this action.

I did an ejectment once through the county on a property I bought at tax sle and the old owner would not move out.

Since the property is still in your name you have a lease and she's a tenant, so you won't have to do a foreclosure. It doesn't matter if she has planned to purchase the property or not. End communication with her and just proceed with the eviction. Get all your paperwork together and get her out. If you're unfamiliar with evictions, then hire a good eviction attorney. Good Luck.

Here in Ohio, you can evict them for non-payment of rent even if they RTO.
