State Specific Question About: NORTH CAROLINA (NC)

I am writing this on behalf of a friend who rents a home in NC. She has only been in this home a few months. The water heater has been leaking and she made the landlord aware of the situation. The landlord did replace the unit on Christmas Day, however, her water bill was $122.00 and her electric bill was $167.00. She and her disabled 3 yr old disabled daughter are the only tenants. She simply can't afford the bills. My question is, is the lanlord responisble for absorbing some of these costs? --74.164.xxx.xx

She should check her lease, but chances are the landlord is not responsible. If the landlord responded within a reasonable amount of time then they will likely bear no responsiblity for the increased bill. Since the landlord replaced the water heater on christmas day I am guessing that they responded very quickly. --66.17.xxx.xx

It mostly depends on when she notified the landlord. If she let him know right away when she moved in that it was leaking onto the floor, then yes, he probably should absorb some of that cost because it took him too long to remedy the situation. But if he came within a couple days of notification, then there really isn't anything he did wrong. Judging by the costs, I think it’s pretty safe to say this thing has been leaking a long time.

I'm sure she'll be more quick to point out appliance issues in the future after this hard lesson.

If she just moved there she has little usage history to base this on, that is what a judge will say if it ever gets that far, she needs to see how the next actual reading bills cost, read the bill carefully as many utils estimate over half the time. --76.241.xxx.xxx

I would think it depends how quickly he responded.

For instance, here, my water bill is about $32/month. BUT the actual WATER is $7, the sewer is $12 and rest is city "fees" that remain the same no matter how much is used. --68.91.xxx.xx

The reason why most rentals the utilities are not included is that there is going to be a high use of water, electricity and natural gas. Those utility costs are not out of line for a house. Maybe one needs to look at conserving electricity by installing compact florescent lights bulbs, water conserving shower head, hang up the clothes instead of using a dryer and turning down the heat at night. --216.110.xxx.xx
