Does your state require that you personally serve him for an eviction? In Michigan, we only have to personally serve them for a money judgment. If we just want them OUT, then the notices can all be POSTED by the process server after they have attempted and failed to serve them in person.
So, I'd double-check your state laws to see if that might apply. You might not actually have to have him personally served to evict him.

Barbara,
1. If you have not already tape a 10 day pay or quit notice on his door.
2. RIGHT NOW file for an eviction in court. Use an attorney if necessary. If using an attorney your costs will roughly, be about 1-2 months rent. If possible ask a local landlord group for the names of LL friendly lawyers and especially a LL friendly judge.
3. In Indiana the sherrif when ordered by the court will evict said tenant. All of this will take about a month.

we just use our constable to serve.no problems.the court usually has a list of constables.if he cant hand deliver he puts a copy on the door and mails one then sends us a form saying service was made.its never been disputed. --208.58.x.xx |
