State Specific Question About: MINNESOTA (MN)
My tenant has not paid rent this month and i dought they will in the future. I gave them a 30 day notice to move on 12-23-09. I am sure they will milk out the system, what can i do to get them the heck out. Befor they moved in the building inspecter sent me a letter of licencing and included a personal not saying, you are one of the very few that i give a licence to on the first visit.Since they have moved in the place is very filthy!! food all over, trash not taken out.cat distroyed carpet,linolium,screens ect. I pay water and heat they pay electric. Can i shut off the water and tell them i cant aford it if they dont pay rent?.Or say the water heater is leaking and need to tun off water till i can afford a new one?. Also i said when they rented they can park there car on the property,can i tell them not to or it will be towed?. There not paying put a big burbin on me paying my morgage. I dont want to sound like a mean person but this is hurting me financialy. What can i do legally to make them as misserable as they have made my finances and get them out?. And they do have a baby in the apt. Please help this is the first time ive had to deal with this as i only have one duplex i rent out-small time landlord. I am so sorry for this painful input!
Shutting off the water is a big no no since you agreed to this on your lease.
Parking violation: Based on what you said,it does not appear that they have violated the parking rules so you cannot have their vehicle towed away
Check your laws on the eviction notice to see how long before you can evict them, the notice to move that you gave them on the 23rd, was that for eviction for non payment of rent or was it a MTM lease expiration notice that you will not renew the following month with no reason needed for termination?
I feel your pain, especially, with the baby in the apt. Dont make the same mistake I made as a newbie and working this business with my heart instead of my head.
They are taking food out of your mouth to feed themselves, they are stealing from you and they just dont care.
I've learned the hard way after losing thousands of dollars to be more firm with tenants and not get too emotional with the tenants, I have a big heart when they have small babies or elderly residing in the home and after all the money I have lost, no more nice gal here, its all business with my head and not my heart.
What I really hate is that we try to help them and they just dont appreciate it and they tear the house up to pieces. You have pigs for tenants and I hope that you can get rid of them soon with an eviction notice.
Dont forget to go to the top of this page and check the LL/TENANT LAWS before you do anything follish and regret it.
I'm sorry that I dont have any good news for you and still want to wish you much luck in getting rid of the dirty scumbags, except the baby, I'm sure the baby is very sweet.
See if any LL from MN can give you some guidance on this matter

Do not turn off any water or doing anything similar. It may sound unusual but you would be the person in trouble if something like that were to occur.
We have all made repairs to homes that haven't paid rent. Paying utilities while not collecting rent is par for the coarse. That is the system.
If you have the time, go down to eviction court and sit a couple of hours, see how things work. Do nothing more than follow the state rules for eviction. Time will go fast enough.
Aside from that, some people make offers to the tenants which we call cash for keys. Hard to do but it has been done for decades, you pay them to leave. When they leave you hand them some cash. I brought that up to underscore that turning off utilities is a self inflicted wound. People would not offer cash to others if they could simply shut off the house.

The ONLY thing you do is serve the appropriate pay or quit notice, then take them to court to evict them.

hiring an attorney for the first phase may be a good idea. tenants like that from my experiences do not want to go into a courtroom when they are going up against a professional. My guess is you may lose a months rent by having the attorney draw first blood by serving them and making a follow up phone call to confirm their intentions. The first move with the attorney should only set you back a couple of hundred. chase them around for the unpaid rent after they are out, if you have the time. My guess is they will leave on the first 30 day notice if they know you have legal representation unless they are pros. at the game. GOOD LUCK --204.14.xx.xxx |

Thank you for all the help!!. Today i seved them a pay or quit notice, and they said they will not be paying the rent and that they will be on public housing next month. They must have had this planed in advance because it takes time to get on public housing. Tomorrow i will contact housing and tell them my history with them and hopefully they will have dug themselves a hole they cant climb out of.I hate to be mean with the baby and all but like the one responder said, buisness is buisness and this has taken a tole on me financialy.I hope they move befor they milk me dry!!. Again thanks too all and i am glad i found this web-site. Oh, they dont know it but i am a contracter for housing when they need services so it maybe easyer to report them and now i know how to run a criminal check on them. The idea of them going on public housing has nothing to do with your lease, before you spend a breath on talking to the housing place find a flat-fee atty who will do the eviction and second action to settle the damage claim for less than 500bux, here we pay 300-350 for both, you will need to have 3 copies of everything regarding the lease and payment schedule to show they did not pay to get the atty going with both feet on the ground. if your liscensing inspector has the same authority as they do here in the town I own in, you could try him. If the apartment is truly filthy, this would probably violate the city rules. Mine state that the tenant must keep the premises as clean as condition permits. If you call in a complaint to the inspector and he finds that the place truly is bad, he could board it up. Some people in my ll group have done this and inspector gave tenants until five that afternoon to get out what they could and not come back. I'm sure you would have to be re-inspected after you cleaned up the mess, but it could be much faster for you.
