Hopefully your rental agreement, or statute allows you to use the security deposit funds for 'any breach of statute or the agreement.

They are charging me late fee, Rent 10 days passed the day I returned the keys, Rekey fee, legal fees, late fees, fee to cut the grass, damages fees ( one my son did and the rest were there when I moved it)and termation fees. --76.182.xxx.xxx

Rent is charged in 30 day segments, unless it is a hotel that charges nightly, fees are used as a penalty for not performing the terms of the contract in a timely manner, other fees are labeled what they are for clarity, you gotta pay if you stay. --76.241.xxx.xxx

Thanks for the replies.I understand the pay if you stay thing and totally agree on it. I was evicted due to a ex stopped playing his child support and alimony and a sick child that had cost thousands in medical bills. I did clean the house from top to bottom with a cleaning service also.I left on the 24th and didnt mind paying the total oct rent but have been charged some of nov also with a termantion fee when they termated the contract by eviction. Also i returned the key and was charge rekey fee. I have also been a landlord but in a different state and these charges would never be allowed there. --76.182.xxx.xxx

What did your lease say?

If you have indeed been a landlord, then you know that no matter what a tenant's personal problems, the rent is still due, just like the mortgage is still due for the landlord whether you pay your rent or not.

Yes! I do know the rent is due and didnt try to fight or prolong a eviction. That is also why I made sure the house was in better shape when i left then went i rented it. I didnt mind paying the whole month and even left the power and water on so the landlord could show the house.I was not months behind at all (just10 days behind when evicted). I understand they also could have had Bills to pay and left bad about it all But my daughter health came above all.I had a all business landlord that gave no room to work with with I can also understand since he had been burnt in the past. But my lease say reasonable damages and nothing about termantion fees. I dont find rekey the locks as a reasonable charge since I returned my key. Nor is replace carpet in a room that was messed up ( and yea they knew this) as reasonable.Nor would they pro rate the one room of carpet my son did mess up. The carpet was no where near new and needed replaced when i moved in and even had rolls in it that could cause on to trip.I agree i should replace the one room at a prorated cost. BUT the other charges I do not understand and didnt know if the state allowed a termanation fees when it isnt stated in lease and a rekey fee( when the key was returned) and the landlord would normally do. --76.182.xxx.xxx

Kimi, if there is no termination fee listed in your lease agreement the landlord cannot suddenly pull one from thin air to charge you.

You can be charged for the carpet, however you can only be charged for the value of the carpet at the time you destroyed it. When landlords sue, they can only sue for the pro-rated replacement value of the carpet. If the carpet is brand new when you moved in, they can sue you for new carpet. If the carpet is five, seven, 10 years or older they can only sue you (or keep from your deposit) the amount that the carpet was actually worth - which is almost nothing! If the landlord keeps money for new carpet from your deposit, rather than being made whole he's being put into a position better than he was to begin with.

As far as rekeying, this is specific to your lease as well. If you returned all the keys, the landlord should not charge you for rekeying unless called for in your lease.

As far as past due rent, you're being honest and admit you owe the rent. He can deduct this fully from your deposit. As far as future rent, he might try to come after you for future rent but usually the eviction stops this. Was there a monetary judgment issued against you in court or was it just an evicton judgment?

Thanks so much. This is just the Termination of Tenancy Statement. Which they have also listed a 342.67 fee for Credit Bureau on also. Also, Thank you for the concern for my daughter, I have finally been able to get her back in school after many months of her having to be homebound. --76.182.xxx.xxx
