State Specific Question About: VIRGINIA (VA)
I just found out that my tenant has had a pit bull since moving into my rental house in 4/09. The lease states no pets allowed. This dog is causing neighbor issues and I want the tenant to get rid of the dog. Do I send a Lease Violation warning letter and give her two weeks to get rid of the dog (my timeframe) or is there a letter similar to the VA 5 day pay or quit that I can use? I am trying to cover my bases in case I have to take her to court. I am planning on calling her tomorrow and then following up with a letter. Thanks. --75.75.xxx.x |

I would give her notice to move in violation of the terms of her lease. I would not or could not trust her in the future and if she brought this dog back or got another one you are liable. Get rid of her. --74.42.xxx.xxx |

She is in violation of her lease, but since it is a remediable breach, you must give a written notice to remedy the issue first.
From what I found, the notice should specify the breach and stating that the rental agreement will terminate not less than 30 days after the tenant's receipt of the notice. The tenant then has 21 days in which to remedy the breach is or the rental agreement shall terminate per the notice. --76.231.xx.xx |

5 days to cure or quit. (they'll drag it out anyway)
%20 per day fine starting on day 6 and a report to city's Animal Control Officer for housng a pet without permission.

this is the type of case where im glad i have a mtm.i would give her 7 days to get rid of the dog.send something in writing.if its not gone i would press for eviction.it should be pretty clear cut.u dont even have to give a reason and shouldnt.maybe say u need the apt for a family member.go by house after a week and walk around.see if dog barks.knock loudly on door .see if dog makes noise.be careful.it might kill u given the opportunity.i would not go into apt.do not rely on what she says.is there another tenant there who u can rely on?maybe they can tell u if dog is gone.did u ask last landlord "how are her pets?"what did he say? --208.58.x.xx |
