State Specific Question About: DELAWARE (DE)

Brief History: Owner below my rental claimed water damage. Insisted it began in May, yet said nothing until Spetember. Stood both myself and my maintenence man up last weekend, claiming she had to buy new tires. We finally got into her unit yesterday. Damage appears to be very old, discoloration of ceiling is indicative of something that happened a very long time ago. My MM scrapes the bubbles from the ceiling and sprays KILZ on it to prevent any further discoloring. Tells her he does not think there will be any further issues with leaks. On our way back to my unit upstairs, he tells me damage is very clearly old, and that it appears her shower is leaking. An hour later she comes up to my place and upon seeing all the work I have done to the place (new floors and appliances), she remarks "you must have some money, you've really fixed this place up. I wish I had some money..." later she calls me to insist that MM returns to paint her wall. He goes down there to explain he doesn't have the paint needed, but would be glad to come back the following morning. She tells him that she has previously gotten money for ceiling damage from former owners. I have owned the place since April 2006, and until she came up to my place last week while I was conducting showings, I had never seen nor met the woman. With hearing that and putting it alongside her statements about the remodeling of my place, I am suspicious that she is trying to pull a fast one. I did leave a message with the HOA, to alert them as to what is going on. But I am worried when my new tenant moves in in two weeks, the neighbor may harass her. She also stood up the MM again today, she claimed she was there until 1pm, he called me at 11:55am and said she was not there. He thinks that I shouldn't have to pay, that she should. I don't know what to do at this point, and am looking for suggestions on how to proceed from here. IMHO, it sounds like she is taking me for a ride. --68.44.xx.xx

I believe she is taking you for a ride. I think right now you need to avoid that person totally, no matter what. I would not care at this point if there was a legitimate problem even, which there is not.

That person needs to go through the home owners association if there is a problem from your unit.

I bought a condo earlier this year in florida. A bank foreclosure that I to this day have never been inside and has not had one dime of work done to it. I had a management company rent it out and it has been occupied for about 7 months.

Obviously I could care less what the downstairs unit could dream up. I could care less about anything that is not in MY best interest. I would however not want to be negligent in any way but that is where the HOA gets invoved.

There are mechanisms built in to the HOA to address things that are important such as you described, I am sure of that.

Really avoid this person 100%. In fact, I could even consider if she keeps bugging or intimidating you, having an attorney sending her a cease and desist or similiar letter.

If you are paying the maintenance man, he needs to stop doing anything in her condo. By sending someone you employ to paint her wall, spray Kilz or anything else could be argued that you have taken responsibility. --68.115.xxx.xx

You are way off limits being anywhere near this lady and specifically in her home.

She baited the trap and you walked in. At this point all the responses from your last post still apply.

My suggestion would be for you to go to court and listen to cases being called. The result may scare you out of this business or clear up what how far fetched accusations are rectified.

The MM should be kicked in the shins, he knows better than to go in there.

With regards to the MM, she was claiming initially that the damage came from my place, and in an effort to shut her up, we came down and inspected things. He was going to tell her that since she wanted it completely sanded down and re-painted, she would have to pay him, not I. --68.44.xx.xx

Have your MM leave a card with the HOA office and a note he will repair this at her expense or HOA but not you- prollybe the end unless you have to phone police about harrasment from her. --76.241.xxx.xx
