I signed a rental agreement with a tenant. He is the only person who is supposed to be living in the home. It has come to my attention that there are several people living in the home without my permission. Will I be legally be able to go to the home and let those not on the lease know that they are not allowed to stay or do I need to break the lease with the tenant which I really don't want to do? --98.192.xxx.xx

first lesson is to face the reality of the world as it truly is and especially in the current economic conditions.

this means that without theses extra people in place and helping your tenant would probably not be paying rent (or at least not to you).

that said... there is no reason for the tenant to go overboard with it or with people that you don't know about or approve of.

1) Set a hard limit on the total number of occupants that will be allowed based on some OBJECTIVE criteria (eg: housing codes and square footage, number of bedrooms, septic capacity etc).

2) Get photo ID on everyone living there and have them complete a credit app so you can do the full background check on them.

3) establish OBJECTIVE criteria for what you will allow as an "occupant" under your tenant's lease.

4) establish OBJECTIVE criteria for what you when you DON'T want an "occupant" under your tenant's lease and instead will insist on a "joint and severally responsible" joint tenant.

there is more but that is a big start on it.

However you choose to handle the issue you must be prepared to stay the course. If you want to tell the tenant to get rid of the occupants, if you want to charge extra for them or if you want to do what mr r says and qulify them (I would not try that0 you must be willing to follow through with that action.

Also if you choose to screen unauthorized applicants you are giving in to unauthorized applicants.

If this is a multi unit then I am more stringent than a low income sfh, those I tend to ignore guests as long s I can. Often problems will rise in units with unauthorized people for various reasons anyway. I usually just collect on those as long as I easily can. --74.99.xxx.xxx

Thanks for the responses. I am still vague on what I should do though. I do not want to "qualify" the folks who are not on the lease, I want them out. They do not help the tenant pay rent in any way. The tenant actually wants them out but unfortunately they are his family. What is the step I should take to have all the ones not on the lease be removed. Since they are not on a leasae with you evicting the tenant after giving a cure or quit notice would be the way you could do it. Of course that is not what you want to hear. The code violtion idea is a good choice, there again YOU will have to enforce it then, basically by giving the tenant a cure or quit notice or tenant faces eviction.

You could also try officially notifying them that they are not allowed to be there and if they stay they are under defiant trespass. Good luck getting law enforcement to support you on that.

tell the tenant in writing what u told us and tell him either the extra tenants go or u all go.i hope the rental agreement says only he can rent the apt.if it was 1 extra i might try to make some arrangemenr but not here. --208.58.x.xx

I am going to take all the good advice and put everything in writing. The lease does state clearly that he is the only one that should be living in the home. There are 3 extra adults and at least 3 children there along with him. --66.237.xxx.xx

I had a similar problem. My attorney told me to evict everyone. Agree with your original tenant that he and his family leave on or before the designated day. After that he walked in the back door alone. --71.61.xxx.xxx
