State Specific Question About: GEORGIA (GA)

Tenant had a one year lease starting Feb 1, 2009

Tenant sent letter May 31st saying use her security deposit for June's rent and that she was leaving. I just now got a replacement tenant but for $50 a month less. Can I collect the missing month's dollars through small claims court. I lost 3 months rent and now will be receiving a lesser monthly rent. I also am an out-of-state landlord. --24.247.xxx.xxx

Sure you can. But! do you know where they are? do they even have it? do they even have it even if you get the judgment?

and more important... back in June did you file on them to start this whole claim?

3 months rent has to hurt but do you think a Judge is gonna hold them to it especially when they gave you notice of their need to go and all that?

The short answer is you lose whatever the judge will not award, typically in court you will get your unit back to change locks and clean up to rerent, the damages claim is the second cause and photo the damages, reducing rent is not damages as you agreed to lower the rent to attract a new tenant right? Loss of remainder of lease income is one thing if the unit needed major floor service or something that rendered it unshowable - how you would justify the less rent amount is a new one for me. --76.241.xxx.xxx

i would go after them for my loss.by the way most usually start rental period in warm weather say sep.with a lease.i just use mtm so it wouldnt affect me much. --208.58.x.xx
