State Specific Question About: VIRGINIA (VA)
Is a stay applicable to delinquency accrued after tenant files for Chapter 13 Bankruptcy. Lessor is not listed as a creditor in Bankruptcy Filing by Lessee as the Lessee was current at time of filing. --24.125.xxx.xxx |

The BK Court cannot discharge the obligation for the post-filing rent, but I believe that the stay is in effect. So you would need pemission from the BK Ct (called "relief from stay") to file either an eviction or a small claims case for the post-petition rent due.
