State Specific Question About: KANSAS (KS)
In Kansas after a tenant moves out the LL has 2 Wks (MOL) to mail them whatever portion of their Deposit they have coming and an explanation of the accounting. There is no requiremeent that mail be other than first class. My question is if for whatever reason they do not have any money due them could the letter be an e-mail? Also say 7 , 14 and 30 day notices, Could they be sent as e-mail? Seems like it would be good for record keeping purposes . Has anyone tested it in the Kansas Legal systeem or had your lawyer give you their opinion ?? --69.148.xxx.xxx |

The reason for Certified Mail with Return Receipt is that you have something to show to the judge if they take you to court for not returning their deposit in a timely manner.
Did they not have a deposit in the first place? If you are keeping the whole thing you need to send copies of the bills for the damage they did.
In this case, I would return at least a couple dollars via personal check and mark it on the bottom front as Security Depost Returned. That way you could show a judge a copy of the check and your notation and the Return Receipt from the Post Office with the tenant's signature.
An email would be hard to demonstrate in court. --76.99.xxx.xx |

You need a record of your attempt to deliver. Send certified mail. A tenant could easily say they didn't get the email. Email is appropriate for some things but this isn't one of them. --74.45.xx.x |

Reid, you stated that the cert mail is not needed, so if you just push it in normal mail - is there a penalty for not sending in a timely fashion? I read here about 2x and 3x returns for not mailing out in a timely manner and using cert mail is the bestway to show this although I guess fed-ex could show similar results as proven attempts until actually signed for the package. --76.241.xxx.xx |

I have used delivery confirmation or Certificate of Mailing on problem tenants. Also the timeline is not 2wks. The deposit refund and accounting of deposit need to get to them within 30days. --165.201.xxx.xxx |
