State Specific Question About: WISCONSIN (WI)

we have been landlords for almost 2 years and required 8 units first time out. with this, came the tenants in question. we are under the no-smoking policy with new rentals. however, this couple smoke in-side their unit along with out-side the building. the worst has been trying to rent to new tenants saying no-smoking allowed and you walk into the building with the "horrible" smell! Their lease is up in March 2010 and want to know what is our procedure in order to NOT renew their lease. we are looking at the whole unit being revamped due to the heavy smoking they have done for God only knows for how long!! General: The first eviction is best done with the help of a flat rate lawyer (abt $350) who specializes in doing them in YOUR court. Part of what he can do is review your lease and explain how it works (good or bad) relative to Wisconsin law. Go to the local rent court and find one. Do this next week. By Friday at the latest have a lawyer working for you to evict these people.

Subject to what the attorney says... it is usually not more than telling them so which is best done in writing. You don't have to get all legalese just say we won't be renewing your lease and would appreciate you leaving ASAP but no later than Feb 28,2010.

I wouldn't delay telling them this. They may just choose to leave before it gets cold and wet.

You need top review your lease and use the correct screening in the future when violations exist use the correct cure/quit to put the tenant on notice. Lets see if Cat or SR has something to add about this. --99.147.xx.xx

I think MrR, and Virden are right let the tenants know where you stand . Anyone with half a brain can figure out it's not worth staying where they're not welcome. The sooner they're gone the happier the other tenants will be. --70.249.xx.xxx
