State Specific Question About: VIRGINIA (VA)
Hello. I am in the process of evicting my tenants. I would like to sue them for lawyer fees, back rent, late fees. Is small claims court the best option? Thanks. --97.123.xx.xxx |

Your eviction case should cover these in the paperwork and requests from the court and any rent not charged in the UD can be gotten through use of Small Claims up to $5,000...make sure your attorney is following the proper time sequence for getting "return" and "trial" dates. --64.12.xxx.x |

Check your state laws in some states Attys aren't allowed in SCC . In Ks you have to sign a statement that you are not now nor have you ever been an attorney to bring a case in SCC. --70.249.xx.xxx |

I agree with asking the atty, maybe your atty has never followed evictions, if he is not a flat fee eviction lawyer - evict him too, expect to pay bout 3-350bux for one to follow the eviction and damage claim case. --76.241.xxx.xxx |

You are the LL? You should know the LL/Tenant laws better then your atty and much better then the tenants. Part of our LL problems winning and collecting is TRUSTING that your attorney knows what he's doing.
