We are in the process of evicting our tenant. I have given them a letter stating when they have to be out of the house. Do I have to wait until that date to file the forcible detainer or can I go ahead and file it now? --208.102.xxx.xxx |

you are jumping the gun.
"forcible" means they aren't "playing well with others" and need Miss Nancy (the Judge) to put them in the naughty corner (out on the curb).
have they REFUSED to leave? have they said or done anything that makes you believe they won't go as you have politely requested them to? Do they have any reason to suspect that you don't have the security deposit to refund when they do leave?

Nicole, I'm concerned readiong your post. Never write anything if you can avoid it.
Do not attempt to make up your own notice. Get a proper pay or Quit notice for your state or have an attorney do a flat rate serving of the notice and maybe the following eviction.
Use an eviction law firm. Not a jack of all trades.
Your letter might be unlawful, a threat or plain silly. Follow the rules or hire legal help. Get this done properly. The only one who can evict is the local judge. --125.25.xx.x |
