State Specific Question About: CONNECTICUT (CT)

I have a question. If I start the eviction process on my tenant after being 2 months behind and than stop because of payment can I hold that back the legal costs in the security when they leave? --64.241.xx.xxx

You should have started on day 6, if you take any payment now it must be the whole amount with late fees and court costs in cash or money order, follow your local laws, state laws are up near the blue boat. --99.128.xx.xxx

does your lease include the term "additional rent" anywhere? (it should)

Don't wait until the end of tenancy to recoup ANY out of pocket expense when you can deduct it from the currently received rent payment.

Also don't start eviction if you don't really want them out for some other reason. use the "pay or quit" to get what is due.

Thanks for the info. Thei housing group came in and helped her pay the monthly charges in the rears. She did pay the back rent. But now that she left she is suing me for twice the security amount.

She owes me for a year worth of late charges (because she owed me one full month for a year)

She moved out mid month and didn't give me 30 day notice.

if she has moved out you don't need to evict and if the back rent is paid you aren't out of pocket (much)... beyond that all you have is a THREAT that she will sue you over the SD money.

This is more as a bluff to keep you from pushing for any other fees you may be due.

I believe your answer will be in SCC IF she ever actually were to sue you. I doubt it will happen.

Have your paperwork file in order and follow through on whatever settlement accounting you're obliged to do but beyond that... Leave sleeping dogs lie.

Thanks for your response. She had her Uncle (Who is a lawyer) ccall me and said if I don't pay he'll take me to court and I would have to pay attorney fees. I said sue me.. and she filed the paperwork. The weird thing is her attorney isn't sueing me with her its just her.

I was willing to let this go, but since she is taking me to court Can I legally counter sue for late fees and eviction fees, even though she paid me before we went to court?

Why is she expecting twice her security? I don't think you can get your eviction fees, but she should still owe late fees and I would think she put here security at risk without proper notice. You have enough legal questions to ask an attorney if you have one that you think is smarter than a professional tenant with a lawyer-uncle --76.188.xxx.xx

i believe u cant start eviction in ct for no pay until the 10th or 11th.i think u should have started then.dont wait for 2 months.u need a landlord tenant atty i think.u need a copy of your state landlord tenant laws.i know in mass u can get in real serious trouble if u refuse to give back security and u havent met legal requirements.triple damages.be careful --208.58.x.xx
