State Specific Question About: VERMONT (VT)

I have 2 questions regarding Day Care within a rental unit

1)I have a tenant that wants to start a Day Care. Is there anyway that I can stop this from happening.

2)How can I state in the lease about not being able to start a business within the rental unit --24.128.xxx.xx

Is she already living in your property?

Is she month to month or on a lease?

If on a lease, and this issue is not addressed, you can't really do anything until lease expires. At that point you can just not renew or modify it.

If she is month to month, you can always modify your rental agreement to say that she can't run business out your rental. --71.198.xxx.xxx

NEver, never, never. Liability is tremendous. Check your insurance policy. Mine addresses this issue of daycare and it is specifically prohibited in the insurance documentation. IF your insurance prohibits it , then you can tell your tenant absolutely not.

If not, I would still tell them no. Again, too too too much liability. --74.45.xx.x

State in the lease that operating a home based business MUST have advance approval by the Landlord.

Many areas require a certain amount of training & certification as well as permits in order to open and operate a day care, things like parking available, --70.106.xx.xxx

I had one for awhile, not quite a full school year, anyway the city inspects often and they need to have some expensive insurance with copies posted, next door was a pizza shop so morning quick parking was easy, afternoons were tough but many moms took home pizza for dinner. They must be capable of cleaning snow and yard mess, check you water heater for no more than 130 outlet temp. --99.147.xx.xxx

Your homeowner's insurance won't allow it. Too much liability. That is your response. --65.186.xx.xxx

Not to mention the extra wear and tear to your property! Who pays the utilities? I hope its not you. --24.224.xx.xx
